Decision on the approval of the Application Regulations of the Law No. 67/1997 on vine and wine

Order for the approval of the list including the geographical indications and traditional mentions adimtted to be used in Romania for wines

CHAPTER III

Guidaince and coordination of the achievement

of the viticultural and enological production

Art. 32. With a view to the fulfilment of the attributions concerning the orientation of the activities in the field of vinegrowing and winemaking as well as for the guidance and specialized technical control in the achievement of the viticultural and enological production, the following bodies subordinated to the Ministry of Agriculture and Food Industry shall be set up and function:

a) The State Inspection for Viticultural and Enological Technical Control:

b) The National Office of Vine and Winc (O.N.V.V.);

c) The National Office for Denominations of Origin for Wines and other Viticultural and Enological Products

(O.N.D.O.V.)

Art. 33. — The State Inspection for the Viticultural and Enological Tcchnical Control shall ensure the supervision of the application of the provisions under the law in the achievement of the production of grapes, of wines, and of other viticultural and enological products, inclusively of those with denomination of origin following up:

a) the observance of the legislation concerning the esta­blishment of grupevine plantations and their clearing off;

b) the observance of the practice and treatments admitted in the production of wines and other viticu1tural and enological products, effectuation of the analytical control of thc wincs and drinks through the agency of authorized laboratories, with a view to their marketing;

c) the exercise of the technical control at all stages of the production of wines and of the other products with denomination of origin as well as on the issue of the necessary documents attesting the quality of the respective products, before marketing:

d) the carrying out of technical cxpertises and analyses in the field of producing grupes, wines, and other viticultural and enological products.

Art. 34. The National Office of Vines and Wine (O.N.V.V.) shall be a specia!ized body with a technical and scientific character, in subordination of thc Ministry of Agriculture and Food Industry, having legal personality and the foilowing object of activity:

a) to substantiate on the basis of studies and analyses the strategy to be developed by Romania in the domain of viticulture and winemaking, and to participate in the establishment of thc methodological framework for the development of the activity in this sector, in agreement with the interests of the national econorny and of the producers as wcll as with international regulations;

h) to endorse the works of delimitation of viticultural areas and tbe distribution into zones of the grapevine varie­ties; to establish the types of wine and of other products on the basis of wine and must authorized for production, inclusively those with denomination of origin as wcll as other works with regard to the development of the viticultural and enological sector.

c)  to endorse technical norms with regard to the establishment of the grapevine cultivation conditions and of the production of wines and of other viticultural and enological products with denomination of origin;

d) to initiate and lend support to viticultural and enological propaganda activities, to national and international profile manifestations as well as to ensure Romania’s connection with international specialist bodies.

Art.35. — The National Office for Denominations of Origin for Wines and other Viticultural and Enological Products (O.N.D.O.V) shall function as a specialist body of thc Ministry of Agriculture and Food Industry with legal personality, having the following object of activity:

a) to issue the necessary documents for attesting the quality of the viticultural and enological products with denomination of origin, and to exercise the control of the observance of their provisions prior to marketing;

b) to initiate and perform actions meant to protect the denominations of origin of the viticu1tura1 and enological products at national and internationa1 level.

Art. 36. — The attributions and mode of organization and functioning of the bodies mentioned under articles 32—35 shall he established by the application regulations of the present law, which shall be approved by decision of the Government.
